Deputies say a Florida man beat his stepson to death for sneaking out of bed to get a cookie on December 30, and then may have made the boy's siblings lie in bed with the boy's body. The family was living at the Masters Inn in Seffner, Florida, WFLA reported. While alone with the children, Montgomery repeatedly punched and kicked the 7-year-old after he got out of bed to get a cookie, Assistant State Attorney Matthew Smith told the court.
An employee at the hotel said he called police after hearing loud shouting in a room, where a man was yelling "beat the kid" and "push the kid over there", WTVT reported, citing the arrest affidavit. They said their brother never woke up after the attack. The man who answered the door of Montgomery's room told the officer that he had been loudly playing music and opened the door wide enough to show four children sleeping in bed. However, according to the arrest affidavit, the deputy didn't enter the room to investigate at the time and cleared the call.
Crews responded to the hotel at 10:50 a.m. after Montgomery called 911 to report that Russell would not wake up.
That morning, Montgomery phoned medical services to report that Brice was unresponsive.
Detectives wrote in the warrant that the other children in the room said they awoke to see Montgomery punching the boy repeatedly in the face before picking him up by one leg and throwing him into a shelf.
According to the Hillsborough County Sheriff's Office, the boy and his three siblings were left in Montgomery's care while their mother was at work.
The children told detectives they saw blood coming from his nose and mouth.
The boy's brothers told investigators that they were forced to watch Montgomery hit him and were threatened with violence if they did not join him.
Montgomery is now facing charges of aggravated child abuse and first-degree murder in the death of his stepson, 7-year-old Brice Russell. Montgomery said that Brice hit his head on the headboard when he threw him onto the bed, but alleges that the child was fine after that.
Jack Junior Montgomery, 31, was being held on $870,000 bond after being charged with the brutal murder of Brice Russell.
He sits booked at the Orient Road Jail.
